Resume
The modern histories of Roman law pass quickly from the ‘geometric’ systemisations of the natural lawyers to the later systemisations of the German historical school. What is missing is the use of Roman law by Scottish philosophers, and in particular, the conspicuously non-systematic use of Roman law by Adam Smith. The oversight is understandable, because Scotland produced no prominent work using Roman law. Fifty years ago, however, a new and extensive account of Adam Smith’s (1723-1790) Lectures on Jurisprudence came to light, and these lectures make full and extensive use of Roman law in a consciously non-systematic fashion. His Roman law is ‘consciously non-systematic’ in the sense that legal institutions find their place in the law, not via intrinsic qualities such ‘nature of the right’ or ‘object of the right’, but via Smith’s own theory of moral decision-making.
